2 Application of the Terms and Conditions

The acceptance of the terms and conditions of sale there implies the enforcement of these conditions. They apply to all orders placed by the customer on the site SPARTOO.EU They involve a contract between SPARTOO and the customer.

These general conditions of sale may be subject to amendment, the version that applies to the customer order is the version that is on the site on the date that the customer places their order. Changes to these terms of sale are binding for customers purchasing after they are posted on line and cannot be applied retrospectively to transactions previous to this date.

All site users must respect the general conditions of sale.

3 Validity of Our Offers

Our offers are intended solely for consumers with a delivery address in Albania, Andorra, Belarus, Bosnia and Herzegovina, Cyprus, Estonia, Iceland, Ireland, Kosovo, Latvia, Lithuania, Macedonia, Malta, Moldova, Montenegro, Norway, Russian Federation, Serbia and Ukraine.

SPARTOO will notify the customer by email should an unavailable item be ordered. In the case of a debit or payment of an item that is not available, SPARTOO commits to propose a credit note or refund to customers within 15 days. The order will be cancelled automatically.

4 Presentation of Products

The items available are described and presented with as much precision as possible. The customer is to read the description of each product in order to know the specific details and properties. The customer needs to inform themselves about the product before placing their order. The choice and purchase of a product is the sole responsibility of the customer.

However, should an error or omission occur within the information, SPARTOO cannot be held responsible. All customers are invited to inform SPARTOO of any error that can be found in a product description.

5 Customer account creation

To place an order, the customer must have created a customer account, at the time of their first order. He / she must complete a form containing the following information: e-mail address, title, surname, first name, sex, date of birth, complete delivery address, telephone number. On this occasion, the Customer creates a password which is personal and for their unique use. Any disclosure to third parties is prohibited.

The Customer undertakes providing complete and accurate information. Any usurpation of identity or false identity may lead to the closure of the account and may lead to prosecution. Any multiple entries, use of the account by several persons or other fraudulent actions may result in the termination of the registration.

The Customer acknowledges having the capacity required to contract and to acquire the products offered on the site SPARTOO.EU.

SPARTOO.EU refuses any sale to minors under 16 years of age without the prior authorization of the parents which will be systematically required.

6 Price of Products

Prices are presented in Euros all taxes included for Albania, Andorra, Belarus, Bosnia and Herzegovina, Cyprus, Estonia, Iceland, Ireland, Kosovo, Latvia, Lithuania, Macedonia, Russian Federation, Serbia and Ukraine, excluding any delivery charges. SPARTOO.EU reserves the right to modify its prices at any time but the products are invoiced at the price in force at the time of registration of the order.

 The tariffs take account of possible reductions that would be granted on the SPARTOO.EU site. These prices are firm and not revisable during their period of validity, as indicated on the SPARTOO.EU site, SPARTOO.EU reserving the right, outside this period of validity, to modify the prices at any time. They do not include the costs of processing, shipping, transport and delivery which may be charged extra, if so specified on the sites. The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.

 An invoice is issued by SPARTOO.EU. It can be downloaded from the website where the order was placed.
 

VAT and Customs Duties

Any order placed on the Site and delivered may be subject to any taxes and customs duties imposed when the package reaches its destination. These customs duties and any taxes linked to the delivery of an article are at the Customer's expense and are the responsibility of the Customer.
SPARTOO.EU is not obliged to verify and to inform the Customer of customs duties and taxes applicable. By ordering on the Site, the Customer is considered as the official importer and obliged to respect all the laws and regulations of the country where the merchandise is received. Clients should be aware that cross-border supplies may be subject to an opening and inspection procedure by the customs authorities.

7 Ordering and Secure Payment

7.1 : Order

The customer confirms the order as follows. By confirming an order, the customer accepts the present Terms and Conditions. A customer who wishes to purchase one or more items available on SPARTOO.EU must follow this procedure to register an order. They must register a customer account on SPARTOO.EU After clicking on the button "Pay Securely Now" and after verifying the contents of their order (colour, quantity, size, price, etc...), the customer confirms the purchase of one or more items with a click.

If the customer has a discount, he/she must enter in the discount code in the space provided on the payment page. First-time customers must fill in a short form which contains the following information: title, first name, surname, complete delivery address, email address, birthday, and telephone number. The customer also creates a password at this time. After having confirmed their payment, the contract for the sale of the goods will be formed. The transfer of ownership of the products sold by SPARTOO.EU to the Customer will only be realized after full and regular payment of the price, regardless of the date of delivery of said products.

It is the Customer's responsibility to verify the accuracy of their order and to let us know about any errors immediately.


7.2 : Payment Methods

  • Payment by Credit or Debit Card

    The Customer confirms their billing address, the product, and the total price. The Customer then provides their card number, the corresponding expiry date, and the security code. The Customer finalises the payment by clicking on the button "Confirm." When clicking on "Memorise", the Customer agrees that the credit card number associated with the expiry date will be retained for future purchases.

  • PayPal

    With PayPal, your financial information is never communicated to SPARTOO.EU. Paypal encrypts and protects your card number. Pay online by simply indicating your email address and password.
  • Payment on Delivery

    Pay for your order in cash upon delivery. We do not accept cheques. If the purchaser does not make payment when the goods are delivered, then the goods will be returned to the seller. This service costs an additional 7.50€. This 7.50€ service charge is not refunded if the order is returned.
  • Bank Transfer

    Pay for your order by transferring your payment directly from your bank. Your order will be shipped once your payment is received by SPARTOO. Please allow for up to 4 working days from the date you transfer your payment for Spartoo to receive your payment. If your payment is not received within 14 working days, your order will automatically cancelled.
  • Payment by Gift Card

    Payment by gift card is possible. The Customer will have to enter in the card number on the payment page where it says "Promotional Codes." If the amount of the order is greater than the amount of the gift card, the Customer will have to complete the payment by another means of payment. If the amount of the order is less than the amount of the gift card, the Customer can use the balance for a next order within the period of validity of the gift card.

7.3: Non-payment

SPARTOO.EU reserves the right to refuse to carry out a delivery or to honour an order placed by a customer that has not totally or partially paid a preceding order or with whom a payment dispute is being handled.

7.4 : Payment Verifications

SPARTOO.EU verifies and monitors all orders that have been placed on its site. These verifications aim to protect SPARTOO.EU from abusive practices: identity theft and payment fraud. SPARTOO.EU may request documents from a customer to verify an order: proof of address and identity of the person ordering, etc.

This order verification will be done prior to your order preparation and it may cause a delay in the preparation and despatch of your order. If we do not hear back from the Customer within the 10 days following the order, the order will be automatically cancelled. Any receipt of non-compliant documents will also result in the cancellation of the order.

7.5 : Right to Cancel

You have the right to cancel the purchase of a good without having to give a reason at any time within the “cooling off period” of seven working days, beginning on the day after you receive the goods. You must notify us of your cancellation in writing or in another durable medium to our contact address. You will receive an email with your return instructions. Follow the given instructions and proceed with your return. All returns which have not followed the correct procedure will require transport to be paid for by the customer. If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us in their original condition to our contact address as soon as possible once you have cancelled the contract.

7.6: Order Details

We adhere to the supplier's contract content and will send you the details of your order as well as our general terms via e-mail. You can find the terms and conditions here at all times. The details about your recent orders can be found in your customer account under the section called "My Orders".

8 Identification

Customers who have already made a purchase at SPARTOO.EU can choose a password which allows them to proceed with new orders without filling the customer detail forms again. The Customer who has already signed up is recognised on the site as being a customer at SPARTOO.EU. The SPARTOO.EU customer's password is strictly confidential and personal. It must never be divulged to a third party.

If the password is forgotten, the SPARTOO.EU Customer can click on the link «Forgot your password? Click here", on the identification page. On the following page, the Customer will have to enter their email address and click on «Send». Customer will then receive a link in his mailbox allowing him to reset the password. This new password will automatically replace the old one.

9 Delivery operated by SPARTOO.EU

Delivery times given are in reference to the order date, and presented in working days (Saturdays, Sundays and bank holidays are NOT taken into account for calculation of delivery time). The delivery times are calculated according to your delivery address. In case of force majeur, Spartoo.eu can not be held responsible for any delay in delivery.

10 Money-back guarantee

All items purchased on the SPARTOO.EU website may be returned if the customer does not wish to keep a product for legitimate reasons: the product does not suit, is not the right size, doesn't like the colour, etc ... SPARTOO.EU products can be exchanged or returned for a full refund.

To be accepted, returns must meet the following specifications:

- The product(s) must never have been worn outdoors. The product(s) must be in like-new condition,
- The returned product(s) must correspond to the product(s) delivered,
- The product(s) is/are returned in the original packaging in good condition,
- The product(s) is/are returned within 30 days of receipt of the order,
- Parcels that arrive empty will NOT be accounted for for any exchanges or refunds,
- Follow the returns procedure below.

Any customer of a country not member of the European Union can exercise a right of withdrawal according to the European directive 2011/83 / EU for all articles purchased on the site SPARTOO.EU. They must do so within 14 days of receipt of the order by the client themselves or by a third party they have mandated. The customer can then be reimbursed in full, as soon as all the products of the order have been received at our warehouse in new condition and in their original packaging. A warehouse check will be systematically carried out on each return. This also includes delivery costs (except for additional costs arising from the fact that the customer has chosen, as the case may be, a mode of delivery other than the least expensive standard delivery mode offered by SPARTOO.EU). The return costs are then responsibility of the customer. The return shall be made without undue delay and in any event not later than 14 days from the receipt of the withdrawal form.


10.1: How to Return an Item:
        

- Cyprus, Estonia, Ireland, Latvia, Lithuania, Malta : free return by UPS. All other return methods will be at the customers' expense.

Albania, Andorra, Belarus, Bosnia and Herzegovina, Iceland, Kosovo, Macedonia, Moldova, Montenegro, Norway, Russian Federation, Serbia and Ukraine: All return costs will be at the customers' expense.


10.2: The return procedure is as follows:
        

Step 1: Log In to Your Customer Account
Sign in to your SPARTOO.EU account with your e-mail address and password and go to the "My Returns" section to complete the return request form.
        

Step 2: Get the Returns Label
- If the return is free of charge, you will receive an e-mail with a link to print off the pre-paid label.
- If the return is at the customers' expense: you will receive an e-mail with the returns address. Keep proof of posting for the return. The return will be processed within 7 to 10 working days.

11 Process Regarding Parcels Not Delivered by Our Transport Provider

These are consignments which have not been delivered to the final destination for the following reasons: Undeliverable, Not Claimed, Refused, Damaged In Transit, Opened...

11.1: Returned as "UNDELIVERABLE":

Consignments returned to Spartoo by the transporter with the following remark: Undeliverable. Once we have received and accepted the undelivered consignment,SPARTOO.EU will contact the customer to propose a new shipment if the product is still available or to offer a refund.
SPARTOO.EU reserves the right to reimburse an order and not to re-ship it if multiple "UNDELIVERABLE" orders have been identified.

11.2: Returned as "NOT CLAIMED":

Consignments which have not been claimed by the customer within the time limit imposed by UPS.
Once we have received and accepted the undelivered consignment,SPARTOO.EU will contact the customer to propose a new shipment if the product is still available or offer a refund.
SPARTOO.EU reserves the right to reimburse an order and not re-ship it if multiple " NOT CLAIMED" orders have been identified.

11.3: Returned as "REFUSED":

The consignment has been refused during delivery attempt. Once we have received and accepted the undelivered consignment, a credit note will put in the customer account within 72 hours following receipt of the undelivered consignment. The Customer may request a refund and thus cancellation of the credit note directly on their customer account. .

11.4 : "DELIVERED" by courier:

The courier claims to have delivered your consignment, either by having a proof of delivery receipt with the customer's signature, the signature of someone in the customer's household, or a neighbour, or the courier claims to have left the consignment in a safe place on the customer's property.

In the event that the consignment cannot be found, a lost parcel claims form will need to be requested from the customer service centre either by email or by telephone. All lost parcel claims forms must be sent by email to the following address: adriana@spartoo.eu.

Once we have received your signed and dated claims form by post, your claim will be processed and either a refund will be processed or a replacement will be shipped, depending on the customer's wishes and available stock.

In the event a consignment is returned to Spartoo as "UNDELIVERABLE ", "NOT CLAIMED ", or "REFUSED", SPARTOO.EU cannot guarantee reservation of the ordered items and may need to reimburse the order if the product(s) is/are not available.

12 Responsibility

For all the stages of access to the site, consultation, filling of forms, ordering, delivery of articles or any other service, the company SPARTOO.EU has only an obligation of means. Consequently, SPARTOO.EU can not be held responsible for any disadvantages or damages inherent in the use of the Internet network which would be external to the precautions taken by SPARTOO.EU. In particular, any disruption in the provision of the service, or any external intrusion or presence of a computer virus, can not engage the responsibility of SPARTOO.EU. Likewise, any act qualified as force majeure within the meaning of the jurisprudence of the Court of Cassation exonerates SPARTOO.EU completely from any liability. Customers benefit from the guarantees granted by the brands present on the site.

13 Intellectual Property

All elements of the SPARTOO.EU site, whether visual or sound, including the underlying technology, are protected by copyrights, trademarks or patents.

They are the exclusive property of SPARTOO.

Any hyperlink referring to the site of SPARTOO.EU and using in particular the technique of framing, deep-linking, in-line linking or any other technique of deep linking is in any case formally prohibited.

In all cases, any link, even tacitly authorized, must be withdrawn upon request by SPARTOO.EU. .

14 Protection of Personal Data

14.1: Personal Data Collection

When creating a Customer Account and when ordering on the SPARTOO.EU site, SPARTOO collects personal data. All the data collected is adequately, relevant and limited to what is necessary for treatment purposes (points 2 and 3). The entity responsible for collecting this data is SPARTOO SAS, Simplified Joint Stock Company, registered under number 489 895 821 RCS GRENOBLE, whose registered office is located at 16 rue Henri Barbusse 38100 Grenoble - France. SPARTOO has declared to the CNIL (French data protection organization) the protection of the personal data of Clients and its fight against fraud: declaration n ° 1182432.
 
The term "personal data" shall mean all data which identify an individual, such as the surname, first name, telephone number, date of birth, gender, e-mail address, postal address, IP address and any information That the Customer will choose to communicate to SPARTOO.EU about themselves.
 
For the purposes of combating fraud as set out below (points 2 and 3), SPARTOO.EU is also likely to keep information for a limited period (point 5) on transactions carried out on its sites, including a truncated part of the bank card numbers used to carry out the said transactions: the last 4 digits of the bank card and their expiry date.


14.2: Purpose of Data Collection

Personal data shall be collected only for specified, explicit and legitimate purposes to fulfill one or more of the following purposes:
- manage the orders on the Site,
-developing trade statistics, conducting market and behavioral studies,
-constitute and manage prospect files, including technical operations such as standardization, enrichment and duplication,
- carry out operations relating to the management of customers,
-select a clientele to carry out prospecting and promotion actions,
- address requests and promotional messages from SPARTOO.EU. The Customer may unsubscribe at any time from these offers by clicking on the link provided at the bottom of the emails concerned.

14.3: Recipients of Collected Data

Only SPARTOO.EU and the external companies contractually linked to SPARTOO.EU for the processing of the Customer's order have access to the information communicated. The categories of persons who will have access to personal data within the company SPARTOO are, within the limits of their respective attributions, the commercial, administrative, technical and control departments (auditors, Internal control procedures, etc.)
 
Personal data may also be sent to public bodies solely for the purpose of meeting legal obligations, auxiliaries of justice, ministerial officials and bodies responsible for collecting debts.
 
All necessary precautions are taken to safeguard the security of personal data and in particular to prevent them from being distorted, damaged or unauthorized by third parties.
 
SPARTOO reserves the right to sell commercially the data it collects on the site if the Customer has checked "I wish to receive more information from Spartoo Partners". You can subsequently withdraw your consent at any time by unchecking the same mention. Any treatment based on consent given prior to withdrawal is lawful.
The company SPARTOO may then have to transfer the data to foreign companies. It undertakes to communicate these data only to foreign companies that have the same level of data protection as France and the European Community.


14.4: Personal Data Retention

The collected data is kept for a period of five years from the last transaction carried out on the site or from the last update of the customer account. Some of your bank details, such as truncated bank card numbers and expiry dates, will be kept for a period of 13 months for fraud-proof purposes. The cryptogram is however systematically destroyed after effective, complete and unchallenged transaction. As part of the Premium service, you can consent to the retention of truncated bank card numbers and their expiry dates for a period of thirteen months from the last transaction you made on the Site or the last update your customer account. This consent is expressed when you check the "Remember" box. You may subsequently withdraw your consent to this retention at any time by giving the same notice. In the absence of a new transaction or update of your customer account during the five-year period, the data concerning you will be deleted automatically.


14.5: Cookies

SPARTOO.EU measures the number of pages viewed, the number of visits and the activity of visitors to the site and their frequency of return through the use of "cookie" technology. A cookie does not identify the Customer. It records information relating to the navigation of the Customer's computer on the SPARTOO.EU site (the pages consulted, the date and time of the consultation, etc.) and to be able to read them during subsequent visits. Data collected by cookies are strictly for internal use only and are never transmitted to third parties. The use of cookies, clean or third party, not necessary for the operation of the site requires an express consent of the Client. The manifestation of the consent or the opposition to the use of cookies is made by a setting of the browser in an appropriate way. 14.7: Reciprocity

The Customer undertakes, for their part, to respect, during any data collection or communication of data from SPARTOO.EU not to Disclose and retain data uniquely for personal use. SPARTOO.EU reserves the right to refuse to communicate any data to a customer.


15 Gift Cards and Money-Off Vouchers

Gift cards or vouchers are in the form of discount coupons with a unique code. Gift cards and vouchers are non-refundable and can not be subject to monetary consideration. However, products purchased with gift cards or vouchers may be exchanged and be credited in the event that they are not suitable. The gift card or voucher will be re-credited to the customer account that used it. These vouchers must be used during their period of validity.

They can’t be combined with other promotions or other coupons.

16 Mediation

If a dispute arises, any customer can send a written request to SPARTOO.EU, who will do their best to resolve it. If the settlement attempt fails, a request to a mediator must be sent within one year of the dispute. The legal guarantee of conformity applies from the receipt of the product for a period varying according to the countries of the European Union.

Proof of the absence of non-conformity is established according to the member countries of the European Union.

The guarantee of conformity does not apply in case of modification on the product, in case of normal wear of the product, in case of improper use of the product, in case of non-respect of the rules of maintenance of the product, and in case of damage caused by transport or storage of the product.

The replacement or repair of the product will be carried out according to the procedures defined for each member country of the European Union, unless this is disproportionate to the damage or if this is impossible. In case of impossibility, SPARTOO.EU will, in a manner defined for each member country of the European Union, make a partial or total reimbursement, as the case may be.

The product in question must have been ordered from the SPARTOO.EU site and returned in its original packaging.

In accordance with the provisions relating to extended producer responsibility (EPR) for those placing textile clothing, footwear and household linen products on the market, SPARTOO has joined the "Refashion" eco-organisation and is registered under the unique identifier number: FR205159_11ECMK issued by ADEME.


20.2: Packaging eco-organisation


In accordance with the provisions relating to extended producer responsibility (EPR) in the context of household packaging waste management, SPARTOO has joined the "ADELPHE" packaging eco-organisation and is registered under the unique identifier number: FR205159_01QZOL issued by ADEME.
